Eighteen Nebraska football players have retained legal counsel to challenge the College Sports Commission over rejected NIL deals, according to Yahoo Sports’ Ross Dellenger. The move comes as third-party NIL agreements face increased scrutiny through the CSC’s fraud prevention measures.

The Huskers players have opted for arbitration to contest the rejected contracts. The process will now include a comprehensive review of each individual deal in question.

NIL Go, the clearinghouse platform that launched following House settlement approval, rejected the deals. The system automatically flags all agreements valued over $600 for approval review.

NIL attorney Darren Heitner believes Nebraska’s challenge could serve as a critical test case for CSC oversight authority.

“Nebraska may be the state that brings down the College Sports Commission and NIL Go platform. State law (§48-3603) is unambiguous. College athletes can’t be penalized for earning or even intending to earn NIL compensation.”

Heitner highlighted the precarious position facing the CSC in his analysis.

“That puts the CSC in an impossible position. Push too hard in arbitration and win? Congrats. You’ve just triggered a direct conflict with Nebraska state law, potentially invalidating enforcement mechanisms across the board. Back down? Your entire compliance framework loses credibility overnight.”

A successful challenge by Nebraska would represent the first major legal victory against the independent college oversight body. The CSC was established to provide uniform regulation across college sports NIL activities.

However, any resolution will likely require a lengthy legal process before reaching completion. The arbitration proceedings could set precedent for how state laws interact with federal college sports oversight.

The House settlement fundamentally changed how NIL deals are processed and monitored. The agreement created new compliance requirements for all name, image and likeness contracts involving college athletes.
